For too long we have let lawmakers and courts take away our property rights. My business was forced to stay in its location for almost two years while planning and zoning boards and ultimately the DOT quibbled about sign sizes, the colors of awnings, historical light posts and a host of other mind numbing details. Never did they consider the deleterious effect this process took on our bottom line. We almost bottomed out.
In the 19th Century the railroads were private enterprises which made deals with prominent politicians to take away other people’s property. The country was growing and more people probably benefited then lost. ‘Just Compensation’ paid for the property and the guilt. This calculation of utility planted the seed for the sovereign to take away your property based on the power of a King.
Decisions like Hawaii Housing Authority v. Midkiff and Poletown v the City of Detroit started this current mess back in the early eighties. In Detroit 4000 residents, over 140 businesses, six churches and one hospital were taken so General Motors could build a new factory. Now they too, are in danger of failure. This was in 1981, the year Sandra Day O’Conner was appointed to the Supreme Court. She was dealing with the same issue when she left last year.
This power of the ‘sovereign’ will continue condemn to neighborhoods for private development. Albany is currently faced with such a challenge. Fight it. Speak loudly and often. Make politicians, bureaucrats and judges listen. Restore the dignity and pride of your families, homes and communities.
Where once perhaps roads or Empire Plazas justified the taking, now private economic advantage is considered a public ‘good’.
Two parties since this nation’s civil war have controlled the process.

While our current Congressman in 20th is out acting like a ‘frat’ brother, one of his four Democratic opponents doesn’t support an immediate withdrawal from another taken property, Iraq , let alone the over 100 countries we are currently in. No more land grabs. No more occupations.
